Unlocks Terms & Conditions

The following terms and conditions ('The Conditions') are the terms on which the Seller ('Unlocks') sells it's services and supersedes all other terms and conditions relating to the subject matter of these Conditions.

  1. Seller -- 'the Seller' is Unlocks.
  2. Buyer -- 'the Buyer' is the person who visits website of the Seller and purchases the Service from the Seller.
  3. Service -- 'the Service' is any service offered in return for payment by the Seller.
  4. Description -- 'the Description' shall be as set out in the Description provided by the Seller to the Buyer.
  5. Price -- 'the Price' shall be the quoted price of the Seller for the Service.
  6. Payment -- 'the Payment' shall be the Payment of the Price to be made by the Buyer before delivery of the Service.
  7. Delivery -- 'the Delivery' shall be the Delivery of the Service to the Buyer at the e-mail address supplied by the Buyer during the request/order submission within the timeframe specified in the Description of the Service.
  8. Acceptance -- Because this is a bespoke service where the Buyer is purchasing an unlock code that is manufactured to the Buyers specifications, the usual '7 Day Cooling Off Period' as set out in The Distance Selling Regulations (2002) does not apply. Therefore, the buyer shall be deemed to have accepted the Service once the Buyer has completed the Payment of the Price.
  9. Title and Risk --
    • 9.1. The Service shall be at the risk of the Buyer following delivery.
    • 9.2. Notwithstanding the Delivery, title in the Service shall not pass to the Buyer until the Buyer has made the Payment of all sums owing to the Seller.
    • 9.3. Until such time as title in the Service passes to the buyer, the Seller shall have the right to withhold the Service.
  10. Limitation of Liability --
    • 10.1. Save in respect of personal injury or death due to the negligence of the Seller, the Seller shall not be liable to the Buyer in respect of any loss suffered by the Buyer due to any defect in the Service.
    • 10.2. Without prejudice to Condition 10.1, the Seller shall not be liable to the Buyer or any third party for any loss of profit, consequential or other economic loss suffered by the Buyer arising in any way from this agreement.
    • 10.3. Save in respect of personal injury or death due to the negligence of the Seller the liability of the Seller under these conditions shall not exceed the Payment.
  11. Force Majeure -- The Seller shall not be liable for any default due to any circumstance beyond the reasonable control of the Seller including, but not limited to, Acts of God, war, civil unrest, riot, strike, lock-out, acts of civil or military authorities, fire flood, earthquake or shortage of supply or failure to deliver of the suppliers of the supplier.
  12. General --
    • 12.1. If any term or provision of the Conditions is held invalid illegal or unenforceable for any reason by any Court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if the Conditions had been agreed with the invalid illegal or unenforceable provision eliminated.
    • 12.2. The Seller may without the consent of the Buyer sublicense it's rights or obligations or any part of the Conditions.
    • 12.3. The headings in the Conditions are for ease of reference only and shall not affect the interpretation of any of the Conditions.
  13. Entire Agreement -- Both the Seller and the Buyer agrees that, save in respect of statements made fraudulently, it shall have no remedy in respect of any untrue statement upon which it relied in entering this agreement and that it's only remedies shall be for breach of contract.
  14. Governing Law and Jurisdiction -- This agreement shall be governed by the laws of England and Wales and both the Seller and the Buyer hereby submit to the non-exclusive jurisdiction of the Courts of England and Wales.
  15. Unlocks Service Guarantee -- the Seller can only guarantee that the Service will fulfill the Buyers expectations if the following criteria are met:
    • 15.1. The information supplied by the Buyer when requesting/ordering the Service is valid, correct and was obtained from the device and not from any other device or a box
    • 15.2. The instructions supplied with the Service have been followed EXACTLY as specified
    • 15.3. The target mobile phone is not faulty, damaged, or blocked / blacklisted
    • 15.4. The target mobile phone is not already unlocked
    • 15.5. The SIM card you wish to use is compatible for use with the target mobile phone
    • 15.6. The target mobile phone has never been subjected to any previous unlock attempts
    • 15.7. The software of the target mobile phone has never been altered, changed or tampered with in any way
    • 15.8. The IMEI/Serial number of the target mobile phone has never been altered, changed or tampered with in any way

    A refund shall not be warranted if all of the above criteria are not met. The Seller will endeavor to solve any problem the Buyer may encounter while attempting to use the Service, however liability for the success of the Service lies solely with the Buyer. Furthermore, the Seller cannot guarantee that the Service will enable the target handset to operate on any specific network. Certain handsets will operate only on certain networks.

  16. Previous Unlock Attempts -- The Seller cannot guarantee success with our the Services if the target handset has been subjected to a previous unlock attempt. An unlock attempt is defined as any attempt to remove the network restriction either directly or by code. The Buyer accepts that a refund, in part or in full, will not be offered or given by the Seller if the Service fails because the target handset has been subjected to a previous unlock attempt.
  17. Incorrect Orders -- It is the Buyers responsibility to ensure that the target handset is supported by the Service. A refund will not be offered or given where the Buyer has paid and subsequently discovered that their handset is not supported by the Service.
  18. Cancellations -- Because this is a bespoke service where the Buyer is purchasing an unlock code that is manufactured to the Buyers specifications, the usual '7 Day Cooling Off Period' as set out in The Distance Selling Regulations (2002) does not apply. Cancellation of an order cannot be accepted once the Payment has been completed.
  19. Failure Claims -- Where the Buyer claims that the Service has failed, and all criteria in Section 15 have been met, the Buyer will be required to supply video evidence to the Seller to support their claim that the Service failed. If the Buyer fails to supply the requested video evidence to the Seller, or if any supplied video evidence does not show that all criteria in Section 15 were met, the Buyer shall not be offered or given a refund or replacement.
  20. Refunds -- Refunds will be issued within 7 Business Days where it is deemed a refund is warranted.
  21. Agreement -- By using our site or purchasing our Services, the Buyer accepts these terms and conditions in full.
  22. Rights of Buyer -- Nothing in these Conditions shall affect the statutory rights of the Buyer.
